1. Introduction

The following Terms and Conditions outline the agreement between Chaz Tours and Travel and the customers who utilize their services. It is important for customers to carefully read and understand these terms before booking any travel arrangements. By using Chaz Tours and Travel, customers acknowledge their acceptance of these terms and agree to abide by them throughout the duration of their trip.

• Purpose: The purpose of these Terms and Conditions is to establish a clear understanding between Chaz Tours and Travel and its customers regarding the rights, responsibilities, and obligations of both parties. The terms aim to provide a framework for a safe and enjoyable travel experience, ensuring transparency and fairness in all interactions between Chaz Tours and Travel and its customers.
• Scope: These Terms and Conditions apply to all individuals, regardless of nationality or residency, who engage in any form of booking or travel arrangements with Chaz Tours and Travel. The scope of these terms includes all aspects of the customer’s journey, from the initial reservation process to the completion of the tour. It encompasses all destinations, activities, accommodations, transportation, and services provided by Chaz Tours and Travel.
• Definitions: For the purpose of these Terms and Conditions, the following definitions apply: “Chaz Tours and Travel” refers to the company providing travel and tour services. “Customer” refers to the individual or group who books and participates in the tour. “Tour” refers to the complete travel package provided by Chaz Tours and Travel, including transportation, accommodation, and any additional services. “Reservation” refers to the act of requesting and securing a spot on a specific tour. “Booking” refers to the confirmed reservation with complete payment. “Cancellation” refers to the termination of a reservation or booking by the customer prior to the tour’s commencement.

2. Booking and Reservation

To secure a booking with Chaz Tours and Travel, customers must comply with the reservation and deposit requirements outlined below.

• To confirm a reservation for any Chaz Tours and Travel package, a non-refundable deposit of 20% of the total tour cost is required at the time of booking.
• The reservation shall be considered confirmed only upon receipt of the required deposit.

3. Payment Schedule

All payments must be made in accordance with the timeline outlined below to ensure confirmation and continuation of the booking.

• Four (4) months before the start of the tour, 50% of the total tour cost is due.
• Two (2) months before the start of the tour, the remaining 30% of the total tour cost is due.
• One (1) month before the tour start date, the final payment of the remaining 50% must be completed.

4. Payment Methods

Chaz Tours and Travel provides multiple payment options to facilitate smooth transactions for clients.

• Payments may be made via bank transfer, credit card, or any other method mutually agreed upon by both parties.
• All bank charges or transaction fees related to payment processing shall be borne by the client.

5. Cancellation and Refund Policy

All cancellations are subject to the policies outlined below and may result in applicable penalties.

• The 20% deposit is strictly non-refundable under any circumstances.
• Cancellations made less than four (4) months before the tour start date will incur a 50% cancellation fee.
• Cancellations made less than two (2) months before the tour start date will incur an 80% cancellation fee.
• No refund will be issued for cancellations made within one (1) month of the tour start date.

6. Changes and Amendments

Any modifications to confirmed bookings are subject to availability and company approval.

• Changes to tour itineraries or travel dates are subject to availability and may incur additional charges.
• Chaz Tours and Travel reserves the right to alter or cancel a tour due to unforeseen circumstances, in which case a full refund will be provided.

7. Travel Insurance

Travel insurance is strongly advised to protect clients against unexpected events.

• Clients are strongly recommended to purchase comprehensive travel insurance covering cancellations, medical emergencies, travel delays, and other unforeseen circumstances.

8. Client Responsibilities

Clients must ensure compliance with all travel-related requirements before and during the tour.

• Clients are responsible for obtaining all necessary travel documents, including valid passports, visas, and health certificates.
• Clients must disclose any medical conditions or special requirements to Chaz Tours and Travel prior to travel.

9. Force Majeure

This clause applies in situations beyond the control of Chaz Tours and Travel.

• Chaz Tours and Travel shall not be held liable for delays, changes, or cancellations caused by events such as natural disasters, strikes, government actions, or other uncontrollable circumstances.

10. Governing Law

This agreement is subject to the legal framework of Kenya.

• This contract shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.

11. Acceptance of Terms

By proceeding with payment, clients confirm their acceptance of these terms.

• By making a deposit or full payment, the client acknowledges and agrees to abide by these Terms and Conditions.
